These Terms of Service ("Terms") apply to your use of clockoutsleep.com (the "Site") and any purchase you make from Clockout Sleep ("Clockout," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
1. Who we are
Clockout Sleep is a business operated by Tran Vinh Vu, located in Vietnam. You can contact us at hello@clockoutsleep.com.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order on the Site.
3. Health and safety information
Our products are general wellness and comfort products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition, including snoring disorders, sleep apnea, or insomnia. Information on the Site is for general information only and is not medical advice.
- Mouth tape and nose strips: Do not use if you have a blocked or congested nose, a cold or respiratory infection, breathing difficulties, a known or suspected sleep disorder such as sleep apnea, or if you have been drinking alcohol or taking sedatives. Do not use on children. Stop use if you feel discomfort, have trouble breathing, or notice skin irritation.
- Massage, heat, and electronic products: Follow the instructions included with the product. Do not use if you are pregnant, have a pacemaker or other implanted device, or have a medical condition, unless your doctor says it's safe.
- If you have any health concerns, talk to your doctor before using our products.
You use our products at your own risk and are responsible for reading and following all product instructions and warnings.
4. Products and pricing
We try to describe and show our products as accurately as possible. Colors and packaging may vary slightly from the images on the Site. All prices are in U.S. dollars. We may change prices, products, or offers at any time. If there's a clear error in a price or product description, we may cancel the affected order and give you a full refund.
5. Orders and payment
When you place an order, you are making an offer to buy. We may accept, limit, or cancel any order, for example if a product is out of stock or if we suspect fraud. If we cancel an order after you've paid, we'll refund you in full. By giving us payment information, you confirm that you are authorized to use that payment method.
6. Subscriptions and automatic renewal
Some products are available as a subscription. If you choose a subscription:
- Your subscription renews automatically and you'll be charged the price shown at checkout, plus any applicable shipping, at the frequency you chose (for example, every 30 days), until you cancel.
- You'll receive an order confirmation for each renewal. We'll notify you by email before any price change takes effect.
- You can cancel at any time before your next billing date from your account page or by emailing hello@clockoutsleep.com. Cancelling stops future charges.
- Refunds for subscription orders are handled according to our Refund Policy.
7. Shipping, returns, and refunds
Shipping is covered by our Shipping Policy. Returns, refunds, and our 30-Night Guarantee are covered by our Refund Policy. Both are part of these Terms.
8. Promotions and discount codes
Discount codes and promotions are subject to their stated terms, can't be exchanged for cash, and may be changed or ended at any time. Unless stated otherwise, only one discount code can be used per order.
9. Reviews and content you submit
If you submit reviews, photos, videos, or other content, you confirm it is truthful and that you have the right to share it. You give us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business, including on the Site and in our marketing. We may remove content at our discretion.
10. Acceptable use
You agree not to misuse the Site, including by breaking the law, infringing others' rights, attempting to hack or disrupt the Site, or using bots to scrape content or place orders.
11. Intellectual property
The Clockout name, logo, text, images, videos, and other content on the Site belong to us or our licensors and are protected by intellectual property laws. You may not copy or use them without our written permission.
12. Third-party services
The Site uses third-party services, such as Shopify and PayPal, and may link to other websites. We are not responsible for third-party websites or services, and your use of them is subject to their own terms.
13. Disclaimer
Except as expressly stated in these Terms and to the extent permitted by law, the Site and our products are provided "as is" and "as available," without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise any specific results from using our products.
14. Limitation of liability
To the fullest extent permitted by law, Clockout will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some places don't allow these limitations, so they may not apply to you.
15. Indemnification
You agree to indemnify and hold Clockout harmless from claims arising from your misuse of the Site or our products, or your breach of these Terms.
16. Governing law
These Terms are governed by the laws of Vietnam, without regard to its conflict-of-law rules. This does not take away any protection you have under the mandatory consumer laws of the state or country where you live.
17. Changes to these Terms
We may update these Terms from time to time. Changes apply from the date they're posted on the Site. Orders placed before a change are governed by the Terms in effect when the order was placed.
